Terms and Conditions of Submitting Tracks to BDWRekordings.com

This agreement will come into force on the 1st March 2010.

BDWRekordings.com Music Submission Agreement

This agreement describes the legal relationship between you (an individual video producer, artist, or, in the case where you are involved with a band, an individual acting as the legal representative of your band) and BDWRekordings.com (refered to us "we" or "us"). By submitting any Song/Track/Video to BDWRekordings.com, its successors, assigns, agents, distributors and licensees, you explicitly confirm that you have read, understood, and agreed to the following agreement:

1. License Grant.

You hereby grant to us, and by the act of delivering your song/track/video to us grant to us, an exclusive, worldwide, royalty-free license to: (a) reproduce, distribute, publicly perform, publicly display and digitally perform the Song/Track/video in whole or in part; (b) create and use samples of the Song/Track/Video solely for the purpose of demonstrating or promoting our or your products or services; (c) use any trademarks, service marks or trade names incorporated in the Song/Track/Video in connection with your material; and (d) use the name and likeness of any individuals represented in the Song/Track/Video only in connection with your material. You also agree that the track will be released under the Creative Commons Deed that you select in this license agreement.

2. Ownership.

You retain ownership of the copyrights and all other rights in your songs, subject to the exclusive license granted to us under this agreement. You are free to upload the material you license to us to social networking websites and any website you own as long as you link back to BDWRekordings.com and adhere to the Creative Commons license.

3. Termination.

You may terminate this license at any time by so notifying us 6 months in advance; the agreement will terminate 6 months from our actual receipt of such notice. We may terminate this agreement at any time without notification. Upon termination, all of our license rights terminate. However, because all releases on BDWRekordings.com are released under creative commons licenses, they will remain creative commons as that cannot be revoked. 4. Samples and Covers.

You agree that all samples contained in the Song/Track/Video are Copyright/Royalty Free, your song/track/video is not a cover version and you will be held liable for copyright infringement.

5. Ad Revenue Share.

You will receive a share of the ad revenue raised by the website. 60 percent of the ad revenue will be devided by how many items of work "signed contributors" have signed to bdwrekordings.com in percentage. For example, if you have contributed 20 percent of "Signed" work released on bdwrekordings.com then you will receive 20 percent of the 60 percent set out for contributers. "Signed contributers" are artists/bands/video producers who have songs/tracks/videos licensed to us.

6. Agreement Changes.

This agreement is subject to change and a notice will be issued to you 30 days before the changes take affect. So you agree to keep us up to date with any change of contact details.

Do You Own The Copyright of My Music?

No, you retain copyright. You only give us exclusive distribution rights to the track.

Can I Upload My Tunes to my Social Network Page?

Yes, aslong as you link to the download page. If this is not posible then you just put our website address.

What If Someone wants to Remix/Cover my tracks?

This all depends on the Creative Commons license you have chosen. If the license is a by-nc-sa, then they can remix/cover and upload anywhere they want, but they have to link to the original tunes web page. They must not sell it unless YOU give them permission. If you have chosen the by-nc-nd license then they must contact YOU the artist before being able to remix/cover it, they can't upload it or sell a remix/cover without your permission.

Can I Put My Tracks On CD For Sale?

Yes, as long as you put our website address in the track details.
